Public Interest Environmental Law: Essential to the Call for a Sustainable Future

WHEREAS,

Public interest legal advocacy is an essential element of democratic institutions; and

Environmental advocacy is a necessary component to the Call for a Sustainable Future, complimenting sound scientific analysis, policy making, and other INGO/NGO activities;

Living free from pollution is emerging as a fundamental right in many nations; and

Potential exists to extrapolate this fundamental right to protect wildlands, critical habitat and biological diversity; and

Even in the absence of this emerging fundamental right, public interest law is a powerful tool for enforcement of laws relating to environmental matters, and for the creation of judge-made laws to protect natural resources; and

Public interest legal advocates have the unique ability to demand judicial review of executive and legislative action, thereby encouraging judicial activism;

WHEREAS,

Public interest environmental litigation is necessary to ensure accountability and transparency in legal systems, assure sustainable natural resource use, and ultimately protect wild areas;

The 6th World Wilderness Congress hereby resolves that:

  • It encourage the continuing efforts of public interest legal advocates (including, but not limited to: Forum for Protection of Public Interest, Nepal; Consumer Protection Group, Madras; Environmental Support Group, Bangalore)
  • Non-government organizations (including, but not limited to: National Tree Growers’ Co-Operative Federation, Munsiari, Uttar Pradesh; The Greens, Assam; Indian Society for Environmental Studies, Bangalore; Environmental Education Centre, Maharashtra),
  • And appropriate support from all relevant government entities.
